RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and authorize the Contracts/Purchasing Officer or designee on behalf of Monterey County, to sign Amendment No. 4 with Bayside Oil II, Inc. adding $100,000 for an amount not to exceed $295,000 for used oil and filter collection, hauling, and recycling in connection with a grant for the County’s Used Oil and Filter Collection and Recycling Program and amending the term of the Agreement to June 30, 2023.

 

SUMMARY:

The Health Department's Environmental Health Bureau coordinates a countywide Used Oil and Filter Collection and Recycling Program.  The State of California’s Department of Resources Recycling and Recovery (CalRecycle) provides annual funding to local jurisdictions to implement their Used Oil and Filter Collection and Recycling Programs.  Bayside Oil II, Inc. acts as the County’s collector, hauler, and recycler for used oil and filters.  A recent increase in the intake of used oil through this program necessitates an increase of agreement funding.

 

DISCUSSION:

Since 1994 Monterey County, through the Health Department 's Environmental Health Bureau, has administered a countywide Used Oil and Filter Collection and Recycling Program.  This program promotes the proper disposal and recycling of used motor oil and oil filters for residents, commercial and recreational boaters, and small farmers in Monterey County.  The County provides community education and makes various outlets available for the proper disposal and recycling of used motor oil and oil filters available through curbside collection, residential drop-off centers, and marine and agricultural oil collection centers.

 

CalRecycle is authorized to make payments to qualifying local jurisdictions for implementation of their used oil programs.  These funds are used to cover costs related to personnel time, acquisition of equipment, supplies, and training to enhance Used Motor Oil and Filter Recycling Program activities.  Bayside Oil II, Inc. provides hauling services for used oil and filters as part this program.

 

Business Automobile Liability Insurance and Indemnification provisions in Amendment No. 2 were revised for consistency with County Standard Agreements.  Hazardous Materials and Environmental Insurance and/or Pollution Legal Liability Coverage provisions had also been added to address the transportation of hazardous materials.

Exhibit A-2 replaces Exhibit A-1 to reflect a change to the E-Manifest fee per project, increasing from $25.00 to $40.00.  All other fees remain unchanged.

 

This work supports the Monterey County Health Department 2018-2022 Strategic Plan Initiatives: 1. Empower the community to improve health through programs, policies, and activities; and 2. Enhance community health and safety by emphasizing prevention. It also supports one of the ten essential public health services, specifically: 6. Enforce laws and regulations that protect health and ensure safety.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel-Risk Management has reviewed and approved this Amendment as to form.  The Auditor-Controller’s Office has reviewed and approved this Amendment as to Fiscal Provisions.

 

FINANCING:

There is no impact to the General Fund resulting from this Board action.  This Agreement is funded through CalRecycle’s used oil program grant.
