RECOMMENDATION:

 

It is recommended that the Board of Supervisors:

Adopt Resolution to Allow Santa Rita Union Elementary School District to Create a School Facilities Improvement District Pursuant to California Education Code section 15303.

 

SUMMARY/DISCUSSION:

 

On June 22, 2022 the Board of Trustees of the Santa Rita Union Elementary School District adopted Resolution 22.061.18 expressing the District’s intent to form a School Facilities Improvement District. This would entail the District placing a bond measure before the School Districts voters at the November 8, 2022 election. The bond measure will ask the voters to authorize approximately $24.9 million for facility improvements within a portion of the School District carved out by way of creation of a “School Facilities Improvement District” pursuant to California Education Code section 15300 et seq

 

Under the California Education Code, a School Facilities Improvement District cannot be created by a School District unless the Board of Supervisors has allowed for its creation within the County by passage of a Board resolution. The Board of Trustees of the School District has requested that the Board of Supervisors adopt such a resolution both by their action on June 22, 2022 and via letter dated July 6, 2022 (attached) from Mr. Daniel Maruccia of the Lozano Smith law firm, attorneys representing the School District.

 

A draft Board of Supervisors resolution is attached to this report.

County Counsel was consulted during the preparation of this Board report and has approved the attached resolution as to form
