RECOMMENDATION:

It is recommended that the Board of Supervisors adopt an urgency ordinance to amend Section 12.28.030 of the Monterey County Code to prohibit parking from 7:00 a.m. to 6:00 p.m. during weekdays on Madison Lane on both sides from Boronda Road easterly to its terminus in the unincorporated area of Monterey County (4/5ths vote required).

 

SUMMARY/DISCUSSION:

In response to the community concerns, Board Referral No. 2022.05 was prepared requesting to codify ‘No Parking’ on Madison Lane in Boronda, and assigned to Public Works, Facilities and Parks (PWFP) at the February 8, 2022 Board Meeting.  The intent of the Referral was to perform the requisite traffic engineering study to support installation of the requisite signage and clarify and strengthen the ability for peace officers to enforce Monterey County Code Section (MCC) 12.28.010 (No Parking at any time).

 

On March 8, 2022, Monterey County PWFP provided the Board a preliminary analysis report in response to said Board Referral.  It is PWFP staff’s understanding from the Board Referral that roadside parking on Madison Lane has created a consistent and increasing public health and safety concern for the community and businesses of Boronda, particularly regarding traffic hazards caused by vehicles parked adjacent to commercial driveways and often obstructing sight visibility, and from parked vehicles creating one lane of travel for the larger trucks and vehicles coming and going from the commercial businesses in the area.

 

In performing the traffic engineering study, staff found that there were residential properties sporadically placed alongside the commercial parcels. The residential parcels had cars parked in front of them at night.  Considering and balancing the parking needs of the residents, a daytime prohibition is better suited to this area.  Applying the daytime parking prohibition would establish a consistent, continuous prohibition of parking vehicles during the daytime hours on weekdays along the entire length of Madison Lane, while allowing residents to park vehicles overnight.  Additionally, since the commercial businesses are generally operating during daytime hours, the proposed parking prohibition would allow the entire pavement width of the travel lanes and improved shoulders (where provided) to be available to the public and to trucks and cars that choose to travel down Madison Lane.  Existing MCC Section 12.28.030 prohibits parking during the daytime hours of 7:00 a.m. and 6:00 p.m. on weekdays.  In order to implement the daytime prohibition, MCC Section 12.28.030 prohibiting parking between 7:00 a.m. and 6:00 p.m. would need to be amended to include Madison Lane.

 

An urgency ordinance is proposed in order to take effect immediately for the immediate protection of the public peace, health, safety and welfare of the County.  Specifically, to prohibit daytime parking on Madison Lane to prevent the obstruction of the travel lanes, and the danger to pedestrians and vehicles in the Boronda community.

 

CEQA

The adoption of this ordinance is categorically exempt under the California Environmental Quality Act (CEQA) pursuant to section 15301(c) of the CEQA Guidelines because the action involves negligible changes to the regulations that govern the existing highways and streets.

 

OTHER AGENCY INVOLVEMENT:

Monterey County requires an amendment to the ordinance in order for the Madison Lane parking prohibition to be enforceable.  The California Highway Patrol (CHP) currently has authority to provide enforcement and issue citations related to operation of motor vehicles on County roads. 

 

FINANCING:

Adoption of this ordinance requires the posting of appropriate signage. These traffic control devices will be funded by the Road Fund. The estimated cost for the installation of new ‘No Parking’ signs is $15,000. Funds are available in the FY 2022-23 Adopted Budget for the Road Fund 002, Unit 8559, Appropriation Unit PFP004 to finance this work.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiative for Infrastructure and Public Safety, Meeting our Facilities, Water, Technology and Transportation Needs. The ordinances will allow for the permanent No Parking between 7:00 a.m. and 6:00 p.m. designation that will improve the quality of life for County residents and support economic development results.
