RECOMMENDATION:

It is recommended that the Board of Supervisors:

a, Approve and Authorize the Sheriff or Sheriff’s Designee to sign the Memorandum of Understanding (MOU) with the City of Carmel, Del Rey Oaks, Gonzales, Greenfield, King City, Monterey, Pacific Grove, Sand City, Seaside, Soledad, Marina and Salinas to provide Local Law Enforcement Agencies access to Automated Fingerprint Identification System (AFIS), effective upon signature.

 

SUMMARY/DISCUSSION:

The Monterey County Sheriff’s Office requests approval of this MOU.

 

The California Department of Justice maintains the automated system for retaining and identifying fingerprints also known as the California Identification System (CAL-ID).

 

Penal Code, section 11112 I et seq, provides for the establishment of a Remote Access Network (RAN) consisting of a statewide network of equipment and procedures allowing local law enforcement agencies direct access to CAL-ID.

 

The County of Monterey has established a local board (RAN Board) which is charged with determining the placement of RAN equipment within the County, coordinating acceptance, delivery and installation and developing procedures for the use and maintenance of the equipment. The RAN Board and DOJ have developed a local Automated Fingerprint Identification System (AFIS) to directly access CAL-ID System.

 

The RAN Board is comprised of the following:

 

A Member of the Board of Supervisors

The Sheriff

The District Attorney

The Chief of Police of the department having the largest number of sworn personnel within the County

A Chief of Police selected by the Monterey County Chief Law Enforcement Officers Association

A Mayor select by the Mayors’ City Selection Committee established pursuant to California Government Code Section 50270

A Member-at-Large chosen by the RAN Board

 

This MOU identifies the purpose, scope, equipment, percentages, etc.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and he County Administrative Office have reviewed. The District Attorneys’ Office supports this MOU.

 

FINANCING:

There are no General Fund Impacts resulting from this Board Action.
