Title: a. Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of Health or Assistant Director of Health to execute a Memorandum of Understanding with King City Union School District (“School District”) to implement the Interconnected Systems Framework and provide mental health support services to students effective retroactively to March 29, 2022 through June 30, 2025; and

b. Approve the recommendation of Director of Health to accept all non-standard provisions in Agreement, including indemnification, limitation of liability, and insurance provisions; and

c. Approve and authorize the Director of Health or Assistant Director of Health to approve up to three (3) future amendments to the Memorandum of Understanding that does not significantly change the scope of services.

 

SUMMARY/DISCUSSION:

The County was awarded a Mental Health Student Services Act (MHSSA) grant through the Mental Health Services Oversight and Accountability Commission to provide mental health support services in Monterey County public schools.  The County will use grant funds to expand clinical services and to train school staff on the Interconnected Systems Framework (ISF) methodology and Positive Behavior Interventions and Supports (PBIS) in King City Union School District.  PBIS is defined as a systems approach for establishing the social culture and individual behavior supports needed for schools to achieve both social and academic success for all students while preventing problem behaviors.  The ISF aims to integrate Positive Behavioral Interventions and Supports and School Mental Health systems into one comprehensive model that can be implemented in a multi-tier framework.  The County will be reimbursed directly by the Mental Health Services Oversight and Accountability Commission for services provided to King City Union School District through this MOU.  This MOU is retroactive to March 29, 2022 due to prolonged contract negotiations.

 

Both parties have negotiated to Mutual Indemnification, Limitation of Liability, increased per occurrence and aggregate liability limits for Professional and General Liability, and County to include sexual misconduct coverage.  The Health Department recommends the modification to the indemnification, liability, and insurance provisions.

 

This work supports the following Monterey County Health Department 2018-2022 Strategic Plan Goal: 3. Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.  It also supports one of the ten essential public health services, specifically: 7. Link people to needed personal health services and assure the provisions of health care when otherwise unavailable.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller have reviewed and approved this MOU as to legal form and fiscal provisions, respectively.  Risk Management has not approved this MOU due to non-standard indemnification, limitation of liability, and insurance provisions. 

 

FINANCING:

Costs associated with this MOU will be funded (100%) with MHSSA grant that was approved by the Board of Supervisors at its July 20, 2021 meeting. The associated revenue and expenditures are included in the Health Department’s Behavioral Health (HEA012, Unit 8410), Fiscal Year’s 2021-22 and 2022-23 Adopted Budgets. Future Fiscal Years revenues and expenditures will be included in the requested Health Department budgets.
