Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.   Approve and authorize the Contracts/Purchasing Officer or Contracts Purchasing Supervisor to execute First Amendment to the License Agreement, effective on January 3, 2023, with the Judicial Council of California, for approximately 1,019 square feet of space located at 250 Franciscan Way, King City, California (commonly known as the King City Courthouse Facility), for use as a Family Justice Center and a satellite Child Advocacy Center.

b.   Authorize the Auditor-Controller to make license fee payments of $788.81 per month and in accordance with the terms of the License Agreement. and

c.   Authorize minor revisions to the First Amendment and the License Agreement if deemed to be in the best interests of the County by the Contracts/Purchasing Officer and subject to review and approval by the Office of the County Counsel.

SUMMARY:

The Judicial Council of California (Judicial Council) and the County of Monterey (County) previously entered into a License Agreement dated January 28, 2020, which granted exclusive use of the jury deliberation room and adjacent restroom consisting of approximately 320 square feet located at 250 Franciscan Way, King City (commonly known as the King City Courthouse Facility) to be used as a satellite Child Advocacy Center operated by the District Attorney’s Office in conjunction with Natividad Medical Center and Department of Social Services for forensic interviews of child sexual assault victims.

The Judicial Council and the County now desire to amend the License to add 699 square feet of court exclusive-use area and 349 square feet of common area space for the Family Justice Center led by the District Attorney’s Office.

The Family Justice Center will provide space for various victim service providers to co-locate and provide a more integrated network of services to victims of domestic violence, adult and child sexual assault, human trafficking and elder abuse who reside in South County. 

Approval of this First Amendment to the License Agreement will continue to provide the Child Advocacy Center with a South County location to conduct child forensic interviews of child sexual assault victims, and related activities on an as needed basis, as well as provide the Family Justice Center - South County Office better access for victims of domestic violence, adult and child sexual assault, human trafficking and elder abuse to receive services from various service providers without the need to travel to the Salinas area or the Monterey Peninsula area. 

This First Amendment to the License Agreement for the new expanded exclusive use space of 1,019 square feet will commence on January 3, 2023.  The License Agreement can be cancelled by either party upon thirty (30) days written notice.

OTHER AGENCY INVOLVEMENT:

The Public Works, Facilities and Parks Real Property Section facilitated negotiations regarding the First Amendment to License Agreement and assisted with the development of this report.  The Office of the County Counsel has reviewed and approved the First Amendment to License Agreement as to form.  The Auditor Controller’s Office has approved as to fiscal provisions.

FINANCING:

There is no financial impact to the General Fund.  Sufficient funds are available in the FY 2022-23 District Attorney (2240) Budget, Fund 001 Unit 8063, Appropriation Unit DIS001.   On-going occupation of the licensed premises will be based on the continued availability of funding.  The first-year leasing cost will amount to $9,465.72.  The license fee will be subject to a 3% increase at the end of each license anniversary year.

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The proposed License Agreement correlates to the Administration, Health & Human Services, and Public Safety Strategic Initiatives adopted by the Board of Supervisors by improving service delivery in South County communities, and providing localized services for residents to receive services from various service providers without the need to travel to the Salinas area or the Monterey Peninsula area when these crimes occur in South County.
