RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize an additional contingency of 10% of the contract amount with Anderson Pacific Engineering Construction, for the Hartnell Road Bridge at Alisal Creek, County Bridge No. 209, State Bridge No. 44C-110, Project No. 385465, State Project No. EA 05-00020138L_N, Federal Aid Project No. BRLO-5944 (103) to provide funding for approved contract change orders; and

b. Authorize the Director of Public Works, Facilities, and Parks (PWFP) to execute contract change orders where the overall total value of change orders does not exceed 20% of the original contract amount, and where the change orders do not significantly change the scope of work.

 

SUMMARYDISCUSSION:

On May 24, 2022, the Board of Supervisors awarded a contract to Anderson Pacific Engineering Construction for the construction of the Hartnell Road Bridge at Alisal Creek Replacement Project, County Bridge No. 209, Federal Aid Project No. BRLO-5944 (103), Project No. 385465.

 

The project consists of a new two (2) lane bridge on the existing alignment, associated approach embankment grading and paving, removal of the existing bridge, and associated improvements on Hartnell Road and realignment of the Alisal Creek, in the total amount of $2,250,698.  As part of this action the Board also authorized a contingency (not to exceed 10% of the contract amount) to provide funding for approved contract change orders, and authorized the Director of PWFP to execute the contract and, subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed 10% of the original contract amount, and which do not significantly change the scope of work.  Construction began on June 24, 2022 and is expected to be completed by the end February of 2023.  As of December 2022, the Project construction is approximately 90% complete.  In addition, a Project mitigation measure requires a two (2) year plant-establishment period.  The contractor will start the plant placement in the spring of 2023.

 

 

During construction, contract change orders have been executed to address unexpected field conditions after recent storms damaged the channel slopes.  The proposed additional work is needed and requested by staff to restore the channel slopes. The County is working with Caltrans to secure funding to cover the additional costs associated with Federal Highway Administration (FHWA) and State Toll Credits funds.

 

The project was partially completed in December 2022.  However, one (1) of the mitigation measures in the County’s permit required a two (2) year plant establishment period.  The contractor has not started the plant placement.  No contract retention was accrued for this project since Federal funds were used for the project.

 

OTHER AGENCY INVOLVEMENT:

PWFP staff is coordinating with Caltrans staff to secure additional funding.

 

FINANCING:

There is no impact to the General Fund.  The total project cost, including engineering, environmental, and construction is $4,494,152.  The Project is financed by the Federal Highway Administration (FHWA) in the amount of $3,840,511, Toll Credit Fund at $497,579, and Measure X at $381,132. The proposed additional 10% contingency would be $225,070, resulting in a total project contingency of 20%, or $450,140.  This will increase the project total to $4,719,222.  There are sufficient appropriations in the FY 23 Annual Work Program for Road Fund, Fund 002, PFP004, for this increase.

 

The contract change order for the slope repair is estimated at $386,000.  The proposed additional contingency amount of $450,140 will cover the additional costs. PWFP staff is coordinating with Caltrans staff to secure additional federal and state funds.  Alternatively, should additional grant funding not be attained, PWFP staff has identified Measure X funds that could be used to cover the additional costs.
