a. Approve a Non-Standard Agreement with Avery Dennison Corporation dba Avery Dennison Reflective Solutions to provide installation services of a CWT 1630 Premium Work Table and extended warranty for the TrafficJet™ Xpert Print System Serial No. 99070S for a total not to exceed amount of $21,750, for a term effective February 28, 2023 to September 19, 2026; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the Non-Standard Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve a Non-Standard Agreement with Avery Dennison Corporation dba Avery Dennison Reflective Solutions to provide installation services of a CWT 1630 Premium Work Table and extended warranty for the TrafficJet™ Xpert Print System Serial No. 99070S for a total not to exceed amount of $21,750, for a term effective February 28, 2023 to September 19, 2026; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the Non-Standard Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.
SUMMARY/DISCUSSION:
The Department of Public Works, Facilities and Parks (PWFP) purchased a TrafficJet™ Xpert Print System (Print System) from Avery Dennison Corporation dba Avery Dennison Reflective Solutions (Avery) to print traffic signs for the County of Monterey. The new Print System will result in cost savings, process improvements, and production efficiencies. This will also eliminate down time caused by reoccurring need for repairs due to the old age of the previous printer. The corresponding CWT 1630 Premium Work Table (Work Table) was also purchased and will require professional installation services by Avery CWT Technical Personnel.
The Print System includes a one (1) year manufacturer’s warranty with the option to purchase up to three (3) additional years of the TrafficJet™ Extended Warranty Prepaid Convenience Plan (extended warranty). PWFP proposes to purchase three (3) additional years of extended warranty for a total of four (4) years of uninterrupted coverage effective the date of delivery, September 20, 2022, through September 19, 2026. Avery was selected based on their exclusive position as the Print System supplier.
PWFP Staff is requesting approval of a Non-Standard Agreement (NSA) as Avery has requested modifications to the County’s Standard Agreement under Sections 6.0, Payment Conditions, 10.0, Records and Confidentiality, 11.0, Non-Discrimination, 12.0, Compliance with Terms of State or Federal Grants, and 13.0, Compliance with Applicable Laws, and has further added paragraph 17.4 under Section 17.0, Consent to Use of Electronic Signatures. The proposed modifications are delineated in the proposed NSA (Attachment A).
PWFP requests the Board of Supervisors approve the proposed NSA with Avery to provide for installation services of the Work Table and an extended warranty for the Print System for a total amount not to exceed $21,750 with a term effective February 28, 2023 to September 19, 2026.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller’s Office have reviewed and approved the NSA as to form, and fiscal provisions, respectively.
FINANCING:
The Road Fund, Fund 002, Appropriation Unit PFP004 has sufficient budget appropriations in fiscal year (FY) 2022-23 to support the cost of the installation and extended warranty.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisor’s Public Safety initiative as the traffic signs provide valuable information, consistent rules and warnings to drivers, pedestrians, and cyclists which increases the effectiveness of the communication.
