RECOMMENDATION:
It is recommended that the Planning Commission:
a. Consider the Monterey County Planning Commission Rules for the Transaction of Business; and
b. Provide direction to staff.

SUMMARY/DISCUSS:
The California Government Code directs the legislative body of a county to assign by ordinance the function of a "planning agency" to a planning department, one or more planning commissions, administrative bodies or hearing offices, the legislative body itself, or any combination thereof it deems appropriate and necessary (Government Code sections 65100 - 65101). The Board of Supervisors created the Planning Commission by ordinance, which is codified in Chapter 2.48 of the Monterey County Code. On August 9, 2023, the Planning Commission adopted modifications to the Monterey County Planning Commission Rules for the Transaction of Business (Rules) (Exhibit A).

Since August 2023, the Planning Commission and staff have encountered circumstances in which the current Rules, specifically Rule 12 - Decision and Rule 13 - Continuance, could benefit from added clarity or modification. Staff asks that the Planning Commission consider its current Rules and provide direction to staff if modifications are desired.

OTHER AGENCY INVOLVEMENT
If the Planning Commission directs staff to modify the Rules, the Office of County Counsel in collaboration with the Housing and Community Development Department will prepare draft modified rules and bring them to the Planning Commission for consideration at a future date.
