RECOMMENDATIONS:

It is recommended that the Board of Supervisors:

a.                      Approve Amendment No. 3 to Professional Services Agreement No. A-12775 with Denise Duffy & Associates, Inc. for environmental review and regulatory permitting services associated with the Carmel River Floodplain Restoration and Environmental Enhancement Project to: expand the scope of services; increase the not to exceed amount of $327,864 by $47,375 for a total amount not to exceed $375,239; and extend the term of the Agreement from July 29, 2017 to June 30, 2018, for a revised term from July 29, 2014 to June 30, 2018; and

b.                      Authorize the Contracts/Purchasing Officer or the Contracts/Purchasing Supervisor to execute Amendment No. 3 to Professional Services Agreement No. A-12775 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

 

SUMMARY/DISCUSSION:

On July 29, 2014, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-12775 with Denise Duffy & Associates, Inc. (DD&A) to provide environmental documentation, California Environmental Quality Act (CEQA)/National Environmental Protection Act (NEPA), and regulatory permitting services for the Carmel River Floodplain Restoration and Environmental Enhancement Project (Project).  Due to new information and on-going coordination and negotiations between the County of Monterey, the California Department of Parks and Recreation (DPR) and the Carmel Area Wastewater District (CAWD), the County and DD&A have identified the need to expand Task 2.2, Task 3.4, Task 4 and Task 6 of the PSA’s original scope of work to include additional and unanticipated analysis, cultural resources consultation, regulatory documentation and review, and meetings.

 

Amendment No. 3 will increase the not to exceed amount of $327,864 by $47,375 for a total amount not to exceed $375,239 and extend the expiration date of the PSA from July 29, 2017 for approximately eleven (11) additional months through June 30, 2018, for a revised term from July 29, 2014 to June 30, 2018.

 

Attachment A provides a summary of the Professional Services Agreement expenditures to date.

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 3 as to form and legality, and fiscal provisions, respectively.

 

FINANCING:

There will be no impact to the General Fund.  There are sufficient funds appropriated under the FY 2016-17 adopted budget within Fund 404, Department 3000, Unit 8174 and Appropriations Unit RMA 015 which authorized a $100,000 increased appropriations from the General Fund to the Facilities Master Plan Projects Fund to cover the cost for the preparation of environmental documents associated with the Project. (See attachment F - Item M).
