a. Approve Amendment No. 3 to Professional Services Agreement No. A-12164 with Kimley-Horn and Associates, Inc. to include revisions to Task 1, Countywide Fee Program Nexus Study, to include additional effort associated with the adoption of the Countywide Fee Program, in the amount of $7,365 for a total amount not to exceed $371,708, and extend the term to December 31, 2015; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to Professional Services Agreement No. A-12164, and up to three (3) future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to Professional Services Agreement No. A-12164 with Kimley-Horn and Associates, Inc. to include revisions to Task 1, Countywide Fee Program Nexus Study, to include additional effort associated with the adoption of the Countywide Fee Program, in the amount of $7,365 for a total amount not to exceed $371,708, and extend the term to December 31, 2015; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to Professional Services Agreement No. A-12164, and up to three (3) future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

DISCUSSION:
Amendment No. 3 to PSA No. A-12164 with Kimley-Horn and Associates, Inc. allows for revisions to Task 1, Countywide Fee Program Nexus Study, to include additional effort associated with the adoption of the Countywide Fee Program. The inclusion of this additional work in the PSA is required to address comments/suggestions raised at the February 26, 2014 Planning Commission Hearing. Amendment No. 3 will increase the PSA in the amount of $7,365, for a total amount not to exceed $371,708, and extend the term to December 31, 2015.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 3 as to form and legality, and fiscal provisions, respectively.
FINANCING:
There is no impact to the General Fund. The cost of the proposed Amendment No. 3 and associated costs for staff time in managing the services will be funded by the Resource Management Agency (RMA) - Public Works Road Fund (Fund 002, Department 3000, Unit 8195, Appropriations Unit RMA 012, Carmel Valley Traffic Impact Fees Account 2653).
