a. Approve Amendment No. 1 to Professional Services Agreement No. A-12775 with Denise Duffy & Associates, Inc. to expand current tasks and to include the preparation of a Water Quality Assessment Report for completion of the Carmel River Floodplain Restoration and Environmental Enhancement Project in the Carmel Area Land Use Plan, in the amount of $65,000 for a total amount not to exceed $321,769, and extend the term to July 29, 2017; and
b. Authorize the Contracts/Purchasing Officer or his designee to execute Amendment No. 1 to Professional Services Agreement No. A-12775 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 1 to Professional Services Agreement No. A-12775 with Denise Duffy & Associates, Inc. to expand current tasks and to include the preparation of a Water Quality Assessment Report for completion of the Carmel River Floodplain Restoration and Environmental Enhancement Project in the Carmel Area Land Use Plan, in the amount of $65,000 for a total amount not to exceed $321,769, and extend the term to July 29, 2017; and
b. Authorize the Contracts/Purchasing Officer or his designee to execute Amendment No. 1 to Professional Services Agreement No. A-12775 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
On July 29, 2014, the Board of Supervisors approved Professional Services Agreement (PSA) No. A-12775 with Denise Duffy & Associates, Inc. (DD&A) to provide environmental documentation, California Environmental Quality Act (CEQA)/National Environmental Protection Act (NEPA), and regulatory permitting for the Carmel River Floodplain Restoration and Environmental Enhancement Project (hereinafter, “Project”) in an amount not to exceed $256,769 for a term of July 29, 2014 through June 30, 2016.
Due to unanticipated additional scope, the County and DD&A have identified a need to amend the PSA for completion of the Project. Amendment No. 1 will increase the PSA by $65,000 for a total amount not to exceed $321,769, and extends the term to July 29, 2017. Expanded project scope includes: Additional coordination meetings with Caltrans and other key agencies to review and clarify existing 2010 CEQA document, Revision of National Environmental Protection Act (NEPA) required technical studies to Caltrans formatting standards (includes Natural Environmental Study and Biological Assessment) and, preparation of a complete Water Quality Assessment Report that was not included in the original scope.
In addition to scope increase, this amendment will also add language to the exiting PSA to memorialize that DD&A’s invoicing and workplace practices fully conform to the standards set forth in the County’s grant funding agreement with the Department of Water Resources (DWR).
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller have reviewed and approved Amendment No. 1 to PSA No. A-12775, as to form and legality, and fiscal provisions, respectively.
FINANCING:
There will be no impact to the General Fund. There are sufficient funds appropriated under the FY 2015-16 Adopted Budget within RMA-Planning 001-3000-8172-RMA001. The FY 2015-16 Adopted Budget included $1,000,000 identified for Long Range Planning and General Plan Implementation of which included an allocation of $65,000 for the Carmel River Floodplain Restoration and Environmental Enhancement Project. Department of Water Resources grant agreement (SAP Agreement No. 4600010665) includes funds for FY 2016-17.
