Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Interim Director of the Information Technology Department to execute a non-standard Agreement between Harris Corporation and the County of Monterey, for $436,000 to provide Software FX security management services for the County Next Generation Radio System (NGEN) for the term of May 15, 2017 to May 14, 2022;

b.                      Approve non-standard agreement terms as recommended by the Interim Director of the Information Technology Department; and

c.                     Authorize the Interim Director of the Information Technology Department to

sign up to two (2) amendments to this Agreement, subject to County Counsel review, which extend services by one (1) year each, where any increased costs do not exceed 10% of the original contract amount ($43,600) per amendment, and do not significantly alter the terms of the Agreement, including non-standard terms approved by the Board.

 

SUMMARY:

The Information Technology Department has provided significant support for the Next Generation Radio System (NGEN) project, which involves upgrading the radio towers throughout Monterey County.  Harris Corporation has provided a systematic approach that allows the County to migrate from an analog system to advanced technology, ensuring that the County’s public safety communication equipment is operating efficiently.  The proposed Software FX provides security management of the County’s communication sites from one location.

 

DISCUSSION:

The County selected Harris Corporation as the primary vendor to implement the NGEN project, which replaces existing public safety and local government voice and data radio networks, as required by Federal Communications Commission (FCC) mandate.

The County is currently upgrading the existing analog conventional radio system to the digital NGEN System; this requires equipment upgrades and modifications on radio towers throughout Monterey County.

 

In support of this project, ITD seeks to purchase the Software FX, which is a security management system administered from one console. This enhancement allows for equipment purchased in support of the NGEN System to be upgraded and secured on a routine basis, as updates become available, in a quick and efficient manner.

 

ITD’s role is to ensure the County’s critical communications systems are up to date and secure.   The purchase of Software FX security management system will ensure public safety communications infrastructure is kept up-to-date with the latest patches, and secured with the latest security releases.

 

ITD seeks to purchase Software FX from Harris Corporation so that public safety communications equipment providing radio communications throughout Monterey County is protected against potential threats

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed this Agreement and cannot approve based upon the following, non-standard provisions:  disclaimer of vendor obligation to ensure compatibility of upgrades with County equipment and software; vendor right to increase annual cost unilaterally; vendor right to discontinue software updates and security patches unilaterally; limitation on amount of damages available to County to amount of fees paid pursuant to the Agreement; vendor’s disclaimer of any other obligations to County; absence of indemnity and insurance provisions protective of County interests; and non-standard vendor signatories.

 

The Agreement was approved as a sole source agreement by the Contracts/Purchasing Officer.   

 

FINANCING:

The funds for payment of the costs of this Agreement have been included in the FY 16-17 Approved Budget for the Information Technology, ITD 1930, Unit 8436.
