RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Authorize the Contracts/Purchasing Officer to execute Amendment No. 3 to the California Forensic Medical Group, Inc. (CFMG dba Wellpath) Professional Services Agreement A-13814, to extend the provision of medical, mental health, and dental care at the Monterey County Jail through December 31, 2025, for a new total aggregate amount of $44,349,032. 

b. Authorize the Contracts/Purchasing Officer to sign up to two (2) future amendments to this agreement where the total amendments do not significantly change the scope of work and do not cause an increase of more than ten percent 10% ($1,518,030.90) of the third-year annual contract amount of $15,180,309.00.

 

SUMMARY/DISCUSSION:

The Office of the Sheriff is recommending amending Wellpath’s current contract for an additional three years to correspond with the remaining time in the Monterey County Jail class action Hernandez v. County of Monterey, et. al. 

 

The three-year amendment would extend Wellpath’s existing contract to December 31, 2025, with the option of two (2), one-year extensions. 

 

In line with rising salaries for nurses and medical providers, the proposed amendment will have increases in staff salaries to make Wellpath more competitive in recruiting medical personnel to work at the jail.  Additionally, new mental health positions will be added in recognition of the ever-increasing mental health treatment needs at the jail and as recommended. Specifically, the amendment would add:

 

40 Mental Health Coordinator hours (1.0 FTE)

28 Mental Health Professional hours (0.70 FTE)

80 Psychiatry Tech hours (2.0 FTEs) - 32 hours will be via telemedicine

40 Discharge Planner hours to facilitate continuity of care (1.0 FTE)

 

Additionally, to ensure adequate medical staffing at the jail, penalties are imposed in cases where Wellpath is unable to meet its contractual staffing commitment.  Similarly, to verify quality of care, penalties are imposed if Wellpath fails to obtain National Commission on Correctional Health Care (“NCCHC”) accreditation.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel has reviewed and approved this amendment as to form, and the Auditor-Controller has reviewed and approved as to payment provisions.

 

FINANCING:

The increase in cost to Wellpath’s contract will be absorbed in the operational budget of the Monterey County Sheriff’s Office this fiscal year.
