Approve and authorize the Treasurer-Tax Collector to execute one future amendment, extending the term for one (1) year with County Counsel’s review, which does not significantly change the terms and conditions including the non-standard provisions, and which does not exceed 10% of the original agreement amount.

RECOMMENDATION:
a. Approve and authorize the Treasurer-Tax Collector to execute a non-standard agreement with Granicus, LLC for short-term rental compliance monitoring and associated services for an amount not to exceed $57,734 with a retroactive term of July 1, 2021 through June 30, 2022;
b. Approve non-standard contract provision as recommended by the Treasurer-Tax Collector; and
c. Approve and authorize the Treasurer-Tax Collector to execute one future amendment, extending the term for one (1) year with County Counsel’s review, which does not significantly change the terms and conditions including the non-standard provision, and which does not exceed 10% of the original agreement amount.
SUMMARY/DISCUSSION:
Granicus, LLC’s (“Granicus”) host compliance service is utilized by the Monterey County Treasurer-Tax Collector Office (TTC) as a component of identification, registering, and monitoring of short-term rentals, as well as pursuing the collection of Transient Occupancy Tax. The Treasurer-Tax Collector has successfully utilized this service via annual agreements since Fiscal Year 2016-17. The service provides an important tool for the identification, registration and monitoring of short-term rentals and assists in ensuring the timely collection of Transient Occupancy Tax.
The Treasurer-Tax Collector seeks to enter into another agreement with Granicus for these services in an amount not to exceed $57,734 with a term of July 1, 2021 through June 30, 2022. The agreement contains the following non-standard provisions: termination terms, indemnification, insurance, other requirements, maintenance of records, royalties and inventions, assignment and subcontracting, and limitation of liability. TTC recommends accepting the non-standard terms as the service agreement for online monitoring services does not represent high risk to the County; however, it does provide for enforcement of transient occupancy actives and tax collection throughout the unincorporated Monterey County. Prior agreements for this service also contained similar non-standard provisions.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has reviewed and approved the agreement as to form.
FINANCING:
The funds for this service in the amount of $57,734 are included in the FY21-22 Approved Budget for the Treasurer-Tax Collector’s office.

The Host Compliance, Inc. web application assists Tax personnel to more fully research and identify providers of short-term rental services and helps ensure a more effective and efficient process for managing the process.
