RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve a Memorandum of Understanding (MOU) between the Monterey County Workforce Development Board and partners of the America’s Job Centers of California system regarding delivery of job training and placement, and other social services, effective June 30, 2019 through June 29, 2022;

b.                     Authorize the Chair of the Monterey County Workforce Development Board and the Chair of the Board of Supervisors to sign the MOU as the Chief Elected Official of the Monterey County local workforce development area, to comply with the Workforce Innovation and Opportunity Act of 2014; and

c.                     Authorize the Chair of the Monterey County Workforce Development Board to execute amendments to the MOU to adjust cost allocations, add partners, and make other changes to its terms necessitated by changed circumstances occurring between June 30, 2019 and June 29, 2022.

 

SUMMARY:

To establish a high-quality America’s Job Center of California (AJCC) One-Stop delivery system, the Workforce Innovation and Opportunity Act of 2014 (WIOA) requires local workforce development boards to develop Memorandums of Understanding (MOUs) with other programs that provide specified services to the public.  These programs are identified in WIOA as One-Stop partners.

MOUs between local workforce development boards and One-Stop partners provide for administration and delivery of WIOA services and related, complimentary services.  The MOUs also establish a visionary plan describing how local workforce development boards and One-Stop partners collaborate to create a cohesive service delivery system that best meets the needs of their shared customers. WIOA requires that the Chief Elected Official for local workforce areas approve One Stop Partner MOUs.

 

As directed by the State of California Employment Development Department (EDD), local workforce development boards were to submit completed MOUs, signed by an authorized representative of the workforce development board, the local Chief Elected Official, and all One Stop partners, to the State EDD Regional Advisor by 5:00 p.m. on June 30, 2019. Due to the lack of access to several signatories, it was not possible to meet the June 30, 2019 deadline for MOU submittal.

DISCUSSION:

The Monterey County Workforce Development Board (WDB) has formed strong working relationships with its service delivery partners over many years.  As required by WIOA, in 2017, it entered into two MOUs identifying 16 organizations as One Stop partners, i.e., service delivery organizations that use the One Stop system to provide both WIOA services and other federal and state social services in the Monterey County local workforce development area.

1.                     Monterey County Workforce Development Board/ResCare Workforce Services - WIOA Title 1 Adult, Dislocated Worker, and Youth services

2.                     State of California Employment Development Department (EDD) - WIOA Title III Wagner Peyser, Jobs for Veterans State Grant (JVSG), Trade Assistance Act (TAA), Unemployment Insurance (UI)

3.                     State of California Department of Rehabilitation - WIOA Title IV Department of Vocational Rehabilitation

4.                     Gonzales Adult School - WIOA Title II Adult Education and Literacy

5.                     Monterey Adult School - WIOA Title II Adult Education and Literacy

6.                     Pacific Grove Adult School - WIOA Title II Adult Education and Literacy

7.                     Salinas Adult School - WIOA Title II Adult Education and Literacy

8.                     Soledad Adult School - WIOA Title II Adult Education and Literacy

9.                     Hartnell College - WIOA Title II Adult Education and Literacy/Carl Perkins CTE

10.                     Monterey Peninsula College - WIOA Title II Adult Education and Literacy/Carl Perkins CTE

The 2017 MOUs have expired by their terms.  Due to the WDB’s educational and other key partners being unavailable during the summer months, the WDB was not able to obtain the necessary partner signatures in time to provide the MOU to the full Workforce Development Board for approval prior to the October 16, 2019 Executive Committee meeting. Based on the WDB’s Bylaws, approved by the Board of Supervisors on November 8, 2016, emergency actions and all other actions taken by the Executive Committee without the prior approval of the full WDB are conditional and subject to either ratification or rescission by the full WDB at the first meeting following the emergency or action.  The WDB’s Executive Committee approved the submittal of the MOU at its meeting of October 16, 2019.

The One Stop Partners listed above are parties to the MOU presented to the Board for its approval in its role as Chief Elected Official of the Monterey County local workforce area.  In the proposed MOU, the One Stop partners that provide services at the AJCC One Stop Center in Salinas and at One Stop affiliate offices, agree on sharing infrastructure costs proportionate to their use of these sites and relative benefits received.

WIOA requires that One Stop partners must use a portion of their funds to pay additional One Stop delivery system costs; costs may be shared through cash, non-cash, or third-party in-kind contributions.  As required, the proposed MOU includes another system costs budget, allocated according to benefit received by each One Stop partner.  The proposed MOU for reconciliation of each One Stop partner’s “other system” contributions on a regular basis

The Monterey County WDB plans to move the existing AJCC/One Stop site to a new site in Salinas in January 2019. It is anticipated that MOU amendments will be required to reflect changes arising from occupying a new AJCC. Thus, the Board is asked to authorize the Chair of the Monterey County Workforce Development Board to sign amendments to the MOU to adjust cost allocations, add partners, and make other changes arising from changed circumstances occurring between June 30, 2019 and June 29, 2022

OTHER AGENCY INVOLVEMENT:

One Stop partners identified in the MOU were involved in the development of the MOU. County Counsel reviewed the proposed MOU as to form. 

FINANCING:

There is no impact on the Monterey County General Fund as WIOA activities are fully financed by federal funds.

Approval of the WIOA One Stop partners MOU will promote the continued delivery of high-quality education, job training, placement and supportive services, thereby enhancing economic development in Monterey County.

 

                     Economic Development - Through collaboration, strengthen economic development to ensure a diversified and healthy economy.

                     Administration - Promote an organization that practices efficient and effective resource management and is recognized for responsiveness, strong customer orientation, accountability and transparency.

                     Health & Human Services - Improve health and quality of life through County supported policies, programs, and services; promoting access to equitable opportunities for healthy choices and healthy environments in collaboration with communities
