a. Approve cancellation of the Sea Otter Classic Sports Festival at Laguna Seca Recreation Area for the year 2020 and a change in date for the 2021 Sea Otter Classic Sports Festival as mutually agreed upon between the County and Sea Otter Classic, Inc.;
b. Approve retaining the deposit paid to County as a credit towards the 2021 facility fee; and
c. Approve and authorize the Assistant County Administrative Officer, or designee, to approve future changes in Sea Otter Classic Sports Festival dates at Laguna Seca Recreation Area, as needed during the pendency of the pandemic or other unforeseen circumstances.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve cancellation of the Sea Otter Classic Sports Festival at Laguna Seca Recreation Area for the year 2020 and a change in date for the 2021 Sea Otter Classic Sports Festival as mutually agreed upon between the County and Sea Otter Classic, Inc.;
b. Approve retaining the deposit paid to County as a credit towards the 2021 facility fee; and

SUMMARY/DISCUSSION:
On December 22, 2016, the Board of Supervisors approved a 15-year Facility Use Agreement between the Sea Otter Classic, Inc., doing business as the Sea Otter Classic, and the County of Monterey to produce the Sea Otter Classic Sports Festival at the Laguna Seca Recreation Area for the years 2017-2031.
Section II - Facility Use Dates and Term, paragraph A, states, "COUNTY reserves the right and shall maintain final control of scheduling of events, including the Sports Festival, at the Laguna Seca Recreation Area. The above scheduled dates can be changed only by mutual agreement between the parties."
