RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve Amendment No. 1 to Professional Services Agreement No. A-15825, Multi-Year Agreement #3200*6422, with MNS Engineers, Inc. to continue to provide construction management services for the Bradley Road Bridge Scour Repair Project, Request for Proposals #10808, to increase the not to exceed amount by $427,309 for a total amount not to exceed $999,967 and extend the expiration date for 1 additional year through June 9, 2027 for a revised term from June 10, 2022 to June 9, 2027, with the option to extend the term for 1 additional year; and

b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 1 to Professional Services Agreement No. A-15825 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

 

SUMMARY/DISCUSSION:

The Bradley Road Bridge (County Bridge No. 448) has a history of scour at the concrete piers in the low-flow channel of the Salinas River.  The Bradley Road Bridge Scour Repair Project (Project) will address undermining of the bridge footings of Piers 16 through 19 and install scour protection at the substructure of the bridge to reduce the potential of future scouring at the bridge foundations.  MNS Engineers, Inc. (MNS) was selected for their expertise and capabilities necessary to provide construction management services for the Project under a competitive selection process in accordance with County policies and State and Federal laws under Request for Proposals (RFP) #10808.  On June 7, 2022 the Board of Supervisors approved Professional Services Agreement (PSA) No. A-15825 (Attachment B) with MNS in the amount of $572,658 to provide construction management services for the Project for a term through June 9, 2026.

 

In March 2021, regulatory Project permits were obtained and prescribed environmental regulations limiting the seasonal window of time to commence construction activities and due to this limitation an additional year is needed to complete the Project.  Additionally, Caltrans requested revisions to various sections of Exhibit B - Federal Provisions to the PSA, including Article V Allowable Costs and Payments, Exhibit 10-H2 Cost Proposal, and Exhibit 10-O2 Consultant Contract DBE (Disadvantaged Business Enterprise) Commitment.

 

Department of Public Works, Facilities and Parks (PWFP) staff recommends that the Monterey County Board of Supervisors approve Amendment No. 1 (Attachment A) to the PSA with MNS to continue to provide construction management services for the Project.  Amendment No. 1 will increase the not to exceed amount of $572,658 by $427,309 for a total amount not to exceed $999,967 and extend the expiration date for one (1) additional year from June 9, 2026 to June 9, 2027, for a revised term from June 10, 2022 to June 9, 2027, with the option to extend the term for one (1) additional year. 

 

Attachments B through E, provided for reference, include PSA No. A-15825, Project Budget, Location Map, and a summary of the annual expenditures and balance of the PSA to date.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively. 

 

FINANCING:

The total estimated cost of the Project, including design engineering, environmental, right-of-way, utilities and construction is $12,118,664.  The County has secured Federal Highway Administration (FHWA) funding for the Project as outlined in Attachment C.  The Project is largely funded by FHWA funds in the amount of $10,580,268.  The Federal funds require an 11.47% local match that will be provided by State Toll Credits fund $1,370,786 and local Measure X funds $167,610.  See Attachment C for further details on the Project budget.

There are sufficient appropriations in the adopted FY 2022-23 Road Fund 002, Appropriation Unit PFP004 budget to finance the construction phase of the project.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety.  The Project will improve bridge safety by reducing the impacts of tidal scour and undermining on Bridge No. 448 in the unincorporated area of Bradley, California.
