a. Approve Amendment No. 2 to Professional Services Agreement No. A-12775 with Denise Duffy & Associates, Inc. to increase the not to exceed amount of $321,769 by $6,095 for a total amount not to exceed $327,864 to allow the completion of tasks required by the United States Fish and Wildlife Services (USFWS) and the California Department of Transportation (Caltrans) to complete the Carmel River Floodplain Restoration and Environmental Enhancement Project in the Carmel Area Land Use Plan, for a term beginning July 29, 2014 through July 29, 2017; and
b. Authorize the Contracts/Purchasing Officer or the Contracts/Purchasing Supervisor to execute Amendment No. 2 to Professional Services Agreement No. A-12775 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. DISCUSSION:
On July 29, 2014, the Board of Supervisors approved PSA No. A-12775 with Denise Duffy & Associates, Inc. (DD&A) to provide environmental documentation, California Environmental Quality Act (CEQA)/National Environmental Protection Act (NEPA), and regulatory permitting for the Carmel River Floodplain Restoration and Environmental Enhancement Project (hereinafter, “Project”). Due to unforeseen circumstances and documentation requirements from the USFWS and Caltrans, the County and DD&A have identified a need to expand specific and existing Project tasks to include the new reporting requirements.
Amendment No. 2 to PSA No. A-12775 reallocates funding from existing tasks to expand and increase funding to other existing tasks to meet USFWS and Caltrans reporting requirements to complete the Project. Amendment No. 2 will increase the PSA by $6,095, for a total amount not to exceed $327,864, for a term beginning July 29, 2014 through July 29, 2017.

FINANCING:
There will be no impact to the General Fund. There are sufficient funds appropriated under the FY 2015-16 Adopted Budget within RMA-Planning 001-3000-8172-RMA001. The FY 2015-16 Adopted Budget included $1,000,000 identified for Long Range Planning and General Plan Implementation of which included an allocation for the Carmel River Floodplain Restoration and Environmental Enhancement project. Work performed by this vendor associated with this project will be funded by grants after June 30, 2016. This project has been included in the RMA’s FY 2016-17 Baseline Budget request under the Facilities Master Plan Project Fund 404, appropriation unit RMA012.
